Privacy Policy

This Privacy Policy explains how Aurum Capital ZA collects, uses, stores, shares, and protects personal information when South African residents use our platform to deposit supported crypto assets, convert them to ZAR, and invest in 30-day tiered investment plans. This Policy is intended to align with the Protection of Personal Information Act, 2013 (POPIA), and applicable Financial Intelligence Centre Act (FICA) obligations.

1. Who We Are

Aurum Capital ZA is a South African investment platform that enables eligible users to deposit BTC, ETH, USDT, or LTC, convert crypto assets to ZAR, and participate in four 30-day tiered investment plans. For purposes of POPIA, Aurum Capital ZA is the responsible party for personal information collected through the platform, unless otherwise stated. We process personal information lawfully, reasonably, and in a manner that respects your privacy.

2. Information We Collect

We collect identity and contact information such as your full name, date of birth, South African identity or passport details, residential address, email address, and phone number. We collect KYC and FICA documents, including proof of identity, proof of address, source of funds information, and any verification records required for compliance. We also collect financial and wallet information such as crypto deposit addresses, transaction hashes, ZAR conversion records, investment plan activity, withdrawal details, device information, IP address, browser data, and cookies or similar tracking information.

3. How We Use Your Information

We use your personal information to create and manage your account, verify your identity, process crypto deposits, convert crypto to ZAR, administer investment plans, and provide customer support. We also use it to comply with FICA, anti-money laundering, fraud prevention, sanctions screening, tax, accounting, and legal obligations. We may use operational data to improve platform security, troubleshoot technical issues, communicate service updates, and protect users and the platform from misuse.

4. Legal Basis Under POPIA

We process personal information where it is necessary to perform our agreement with you, including account administration, transaction processing, and investment plan management. We also process information to comply with legal obligations under FICA and other applicable laws, and where processing is necessary for our legitimate interests in security, fraud prevention, and service improvement. Where required by law, we will request your consent, and you may withdraw that consent subject to legal or contractual restrictions.

5. Sharing With Third Parties

We may share personal information with payment and crypto processors, blockchain analytics providers, wallet infrastructure providers, KYC and identity verification providers, and banking or settlement partners where necessary to operate the platform. We may also share information with regulators, law enforcement agencies, the Financial Intelligence Centre, courts, auditors, legal advisers, and other authorities where required or permitted by law. Service providers that support hosting, communications, analytics, security, and customer support are required to handle personal information securely and only for authorised purposes.

6. International Data Transfers

Some third-party service providers or technology infrastructure used by Aurum Capital ZA may be located outside South Africa. Where personal information is transferred internationally, we take reasonable steps to ensure that the recipient is subject to appropriate safeguards, comparable privacy protection, contractual obligations, or another lawful transfer mechanism under POPIA. By using the platform, you acknowledge that certain processing may involve secure cross-border storage or access where necessary to provide our services.

7. Data Retention

We retain personal information only for as long as necessary for the purposes described in this Policy, unless a longer retention period is required or permitted by law. FICA and related compliance records may be retained for statutory periods after the end of the business relationship or completion of a transaction. When information is no longer required, we will securely delete, anonymise, or restrict access to it in accordance with applicable legal and operational requirements.

8. Your POPIA Rights

You have the right to request access to the personal information we hold about you and to ask that inaccurate, outdated, incomplete, or misleading information be corrected or updated. You may request deletion or restriction of personal information where legally permissible, and you may object to certain processing on reasonable grounds under POPIA. You also have the right to lodge a complaint with the Information Regulator of South Africa if you believe your personal information has been processed unlawfully.

9. Security Measures

We use reasonable technical and organisational safeguards designed to protect personal information against loss, unauthorised access, misuse, alteration, or disclosure. These measures may include encryption, access controls, monitoring, secure storage, verification procedures, and staff or service provider confidentiality obligations. No digital platform or blockchain-related service can guarantee absolute security, and users are responsible for safeguarding their login credentials, devices, and wallet information.

10. Children's Privacy

Aurum Capital ZA is intended only for South African residents who are legally able to enter into binding agreements and use investment-related services. We do not knowingly collect personal information from children or minors without the required consent of a competent person, where applicable. If we become aware that a minor has provided personal information without proper authorisation, we will take reasonable steps to delete or restrict that information.

11. Cookies & Tracking Technologies

We may use cookies, pixels, log files, and similar technologies to keep the platform functional, remember user preferences, enhance security, measure performance, and understand how users interact with our services. Some cookies are necessary for authentication and fraud prevention, while others may support analytics or service improvement. You may manage cookie preferences through your browser settings, but disabling certain cookies may affect platform functionality.

12. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our services, legal requirements, security practices, or operational processes. The updated Policy will apply from the date it is published or otherwise communicated through the platform. Continued use of Aurum Capital ZA after an update means you acknowledge the revised Policy, subject to any consent requirements under applicable law.
