Legal
Terms & Conditions
By creating an account, depositing funds, or using Aurum Capital ZA, you agree to these Terms and Conditions and enter into a binding agreement with Aurum Capital ZA.
1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into financial agreements in your jurisdiction. By using the platform, you confirm that your participation is lawful and that you are acting for yourself and not on behalf of an undisclosed third party. Aurum Capital ZA may refuse access where eligibility, compliance, or verification requirements are not met.
2. Account Registration & FICA Verification
You must provide accurate, current, and complete information when registering an account and must keep that information updated. Aurum Capital ZA may require identity documents, proof of address, source-of-funds information, and other records needed for verification under the Financial Intelligence Centre Act and related anti-money laundering rules. Personal information is processed in line with the Protection of Personal Information Act and is used for account administration, compliance, security, and service delivery.
3. Deposits & ZAR Conversion
Investors may deposit BTC, ETH, USDT, or LTC using the deposit instructions provided in their account. Once a deposit is received and confirmed, the crypto amount is converted to South African Rand at the applicable live exchange rate available to Aurum Capital ZA at the time of processing. Network fees, blockchain delays, price movements, and exchange-rate changes may affect the final ZAR amount credited to your wallet. You are responsible for sending deposits to the correct address and using only assets supported by the platform.
4. Investment Plans & Returns
Aurum Capital ZA offers four 30-day tiered investment plans based on the ZAR amount allocated from your wallet. Bronze applies to R1,000–R10,000 and reflects 70% annual, 5.8333% monthly, and 0.1944% daily returns; Silver applies to R10,001–R100,000 and reflects 80% annual, 6.6667% monthly, and 0.2222% daily returns; Gold applies to R100,001–R1,000,000 and reflects 90% annual, 7.5% monthly, and 0.25% daily returns; Diamond applies to R1,000,001–R10,000,000 and reflects 100% annual, 8.3333% monthly, and 0.2778% daily returns. The relevant tier is determined by the amount you choose to invest at the time the investment is created. Returns are calculated in ZAR according to the plan selected and the stated daily rate for that tier.
5. Profit Accrual & Maturity
Daily profit accrual begins on the 1st day of the calendar month following the date on which the investment is made. The plan duration is 30 days from that accrual start date. At maturity, the invested principal and accrued profit are credited back to your ZAR wallet on the platform. Amounts in the ZAR wallet may then be reinvested or withdrawn, subject to these Terms and any applicable checks.
6. Withdrawals & 30-Day Notice
Withdrawals from the ZAR wallet may be requested through the platform, subject to verification, security review, banking availability, and compliance requirements. If you request a withdrawal from an active investment before maturity, a 30-day notice period applies before funds may be released. Aurum Capital ZA may delay or decline a withdrawal where required by law, where account information is incomplete, or where suspicious activity is identified. Withdrawal processing times may vary depending on payment providers, banks, blockchain networks, and internal review procedures.
7. Fees
Aurum Capital ZA may charge platform, administration, conversion, withdrawal, or other service fees where such fees are disclosed on the platform or communicated to you before the relevant transaction is completed. Third-party costs, including blockchain network fees, exchange spreads, bank charges, and payment-provider fees, may also apply and may be deducted from the amount received or paid out. Fees may change from time to time, but changes will not affect transactions that have already been completed. You are responsible for reviewing applicable fees before making deposits, investments, or withdrawals.
8. Risk Disclosure
Investing involves risk, and you should only invest amounts you can afford to place at risk. Crypto assets are volatile, transactions can be irreversible, exchange rates can change quickly, and technical or market conditions may affect deposits, conversions, withdrawals, and platform operations. Past performance, stated plan rates, or published information should not be treated as a promise of future outcomes. You are responsible for obtaining independent financial, legal, and tax advice before using the platform.
9. Prohibited Use
You may not use Aurum Capital ZA for unlawful activity, fraud, money laundering, terrorist financing, sanctions evasion, market abuse, or any activity that breaches applicable law. You may not create accounts using false information, access another person’s account without permission, interfere with platform systems, or attempt to bypass security and compliance controls. Aurum Capital ZA may investigate, restrict, report, or block activity that appears to breach these Terms or applicable legal obligations.
10. Intellectual Property
All platform content, branding, software, designs, text, graphics, data, and other materials made available by Aurum Capital ZA are owned by or licensed to Aurum Capital ZA. You are granted a limited, revocable, non-transferable right to use the platform for your personal investment activity in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, scrape, resell, or exploit any part of the platform without prior written permission.
11. Suspension & Termination
Aurum Capital ZA may suspend, restrict, or terminate your account if you breach these Terms, fail verification, provide false information, create compliance risk, or use the platform in a harmful or unlawful way. We may also suspend access to protect users, the platform, or our service providers during technical issues, security events, or legal reviews. Where reasonably possible and lawful, we will notify you of the reason for suspension or termination and any steps needed to resolve the issue. Termination does not remove obligations that arose before the termination date.
12. Limitation of Liability
To the maximum extent allowed by South African law, Aurum Capital ZA is not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profit, data, opportunity, or goodwill. Aurum Capital ZA is not responsible for losses caused by blockchain failures, exchange-rate movements, third-party providers, bank delays, cyber incidents beyond reasonable control, incorrect wallet addresses, or your breach of these Terms. Nothing in these Terms excludes liability that cannot legally be excluded under applicable law. The platform is provided on an operationally reasonable basis, but uninterrupted or error-free access cannot be promised.
13. Indemnity
You agree to indemnify and hold Aurum Capital ZA, its directors, employees, contractors, agents, and service providers harmless from claims, losses, damages, penalties, costs, and expenses arising from your use of the platform. This includes claims linked to your breach of these Terms, unlawful conduct, inaccurate information, tax obligations, or misuse of an account, wallet, payment method, or crypto transaction. This indemnity applies to the extent permitted by law and continues after your account is closed.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa. You agree that your use of Aurum Capital ZA is subject to South African legal and regulatory requirements, including applicable rules relating to financial crime prevention, consumer protection, privacy, and electronic communications. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
15. Dispute Resolution
If a dispute arises, you should first contact Aurum Capital ZA so that we can attempt to resolve the matter informally and in good faith. If the dispute is not resolved within a reasonable period, either party may refer the matter to mediation, arbitration, or a competent South African court, depending on the nature of the dispute and applicable law. Nothing in this section prevents either party from seeking urgent interim relief where necessary.
16. Amendments
Aurum Capital ZA may update these Terms from time to time to reflect changes in law, regulation, platform features, fees, risk controls, or business operations. Updated Terms will be made available through the platform or other reasonable communication channels, and the effective date may be stated with the update. Continued use of the platform after the updated Terms take effect means you accept the revised Terms. If you do not agree to the changes, you should stop using the platform and contact support about closing your account.
17. Contact
Questions, notices, support requests, and complaints may be sent to Aurum Capital ZA at support@aurumcapitalza.partners. You should include your registered name, account reference, a clear description of the issue, and any relevant transaction details. Aurum Capital ZA will aim to respond within a reasonable time, although complex, compliance-related, or third-party-dependent matters may take longer to resolve.
